Alabama Gov. Signs Law Prohibiting State-Chartered Banks from Denying Service Due to Beliefs

MONTGOMERY, Ala. — Alabama Gov. Kay Ivey has signed an executive order aimed at ensuring residents have fair and lawful access to financial services, prohibiting state-chartered banks from denying services based on customers’ political or personal beliefs.

Executive Order No. 743 directs Alabama banking institutions to provide services to customers engaged in lawful activities without discrimination tied to beliefs, affiliations or political views.

“Alabamians count on being able to utilize banking services for their own financial security and prosperity, and such access underpins the stability of our economy,” Ivey said in a statement. “State-chartered banking institutions must not restrict the use of financial services based on customers’ beliefs, political views or involvement in legal activities.”

The order follows a similar federal action. In August 2025, Donald Trump signed Executive Order No. 14331, titled “Guaranteeing Fair Banking for All Americans,” which stated that individuals should not be denied financial services based on constitutionally protected beliefs or affiliations.

What Code Requires

Alabama officials said the state’s action is consistent with existing law. The Alabama Banking Code requires state-chartered institutions to operate in a safe and sound manner while serving the needs of their communities and providing services to law-abiding citizens.

Mike Hill, superintendent of the State Banking Department, said the order aligns with the agency’s longstanding position.

“No person shall be denied access to financial services solely due to their beliefs, affiliations, political views or engagement in lawful activity,” Hill said, adding that while state-chartered banks have generally provided fair access, the policy should be followed immediately by all such institutions.

Under the order, the State Banking Department is directed to issue guidance outlining expectations for compliance, including maintaining safe, sound and lawful banking practices.
