CHICAGO–The Seventh Circuit Court of Appeals issued an order outlining a briefing schedule for the continued litigation surrounding the Illinois Interchange Fee Prohibition Act (IFPA), which is strongly opposed by credit unions.

As the CU Daily reported here, last week, Illinois Attorney General Kwame Raoul filed a notice of appeal to the Seventh Circuit Court of Appeals following a district court’s ruling that prevents the IFPA from applying to federal credit unions, as well as national banks, state banks chartered outside Illinois, and payment card networks.
As it currently stands, the law only applies to state-chartered institutions.
The schedule indicates the Illinois Attorney General’s brief is due Nov. 23, 2026, with a reply brief from plaintiffs that include America’s Credit Unions and the Illinois Credit Union League due by Dec. 21. The Attorney General’s reply brief is then due Jan. 11, 2027, with an oral argument date set no later than the end of February 2027, according to America’s Credit Unions.
